PLEASE READ THESE TERMS CAREFULLY BEFORE USING YEARNING MAP. By accessing or using the platform, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them. If you do not agree, you must not use the service.

1. About Yearning Map

Yearning Map (“Yearning Map,” “we,” “us,” or “our”) is a digital platform that allows users to write, store, schedule, and deliver personal messages to intended recipients at a future date and time.

Yearning Map is a technology service that facilitates message creation and scheduled delivery. It is not a party to the messages, relationships, disputes, promises, agreements, or transactions between users.

Yearning Map does not act as a representative, agent, mediator, counselor, fiduciary, or guarantor for any user or recipient.

The platform does not endorse, verify, adopt, or guarantee the accuracy, sincerity, legality, or appropriateness of user-generated messages.

2. Nature and Limitations of the Service

Yearning Map provides technical functionality for composing, storing, scheduling, and attempting to deliver messages.

You acknowledge and agree that:

  1. Yearning Map is a message platform, not a guarantee that a message will reach its intended recipient.
  2. Scheduled delivery is a target, not an assurance of delivery at an exact date, time, or second.
  3. Delivery may be delayed, interrupted, unsuccessful, duplicated, or otherwise affected by technical failures or circumstances outside our reasonable control.
  4. A message marked as delivered does not necessarily mean that the recipient has opened, read, understood, accepted, or responded to it.
  5. Yearning Map cannot guarantee that a recipient will remain available, maintain an account, or be willing or able to receive a message at the scheduled time.
  6. Features may be modified, suspended, restricted, or discontinued when reasonably necessary for maintenance, security, legal compliance, or business operations.

Yearning Map does not guarantee that the platform will always be available, error-free, secure against every possible threat, or compatible with every device or system.

3. Eligibility and User Accounts

You must be at least eighteen (18) years old to use Yearning Map.

You are responsible for providing accurate registration information, maintaining the confidentiality of your credentials, and protecting your account and recovery codes.

Where account recovery depends on a recovery code or other designated recovery mechanism, you acknowledge that losing the required credentials may result in permanent loss of account access.

We cannot guarantee recovery of an account or its contents where the information necessary for recovery is unavailable.

You must promptly take reasonable steps to secure your account if you suspect unauthorized access.

Activities conducted through your account may be attributed to you unless applicable law requires otherwise or evidence establishes unauthorized use.

You may change your username up to three (3) times in total, with at least seven (7) days between changes.

4. User Responsibility for Messages

You retain responsibility for the content you create, store, schedule, and send through Yearning Map.

You represent that you have the necessary rights and lawful basis to submit and transmit your messages and that your use of the platform does not violate applicable law or the rights of another person.

You must not use Yearning Map to:

  • Threaten, harass, stalk, intimidate, defame, or unlawfully target another person.
  • Send unlawful, fraudulent, deceptive, abusive, or malicious communications.
  • Distribute spam, scams, malware, or other harmful material, including by misusing invitation links.
  • Violate intellectual property, privacy, confidentiality, or other legally protected rights, including by uploading a profile photo you do not have the right to use.
  • Impersonate another person or misrepresent your identity for unlawful purposes.
  • Circumvent account restrictions, blocking mechanisms, or security controls.
  • Use the platform for any unlawful purpose.

You are responsible for considering the potential consequences of your messages, including their emotional, personal, professional, and legal implications.

Yearning Map does not determine whether a message is appropriate for a particular recipient and does not guarantee that sending a message will produce any particular outcome.

5. Scheduled Messages and Delivery

Yearning Map allows users to schedule messages for future delivery.

You acknowledge and agree that:

  1. Scheduled messages may be subject to a delivery lock that prevents viewing or editing after scheduling, where that functionality applies.
  2. A scheduled message may not be editable once the schedule has been confirmed.
  3. Cancellation may be available before delivery processing begins, subject to the platform’s functionality.
  4. Cancellation does not guarantee that a message already transmitted to an external delivery system can be recalled.
  5. Once a message has been delivered or made available to a recipient, Yearning Map cannot guarantee its removal from the recipient’s account, device, notifications, screenshots, backups, or other records.
  6. A scheduled message may not be delivered if the sender’s account is deleted, the recipient blocks the sender, a technical failure occurs, or another applicable restriction prevents delivery.

Users are responsible for checking their intended recipient, message content, schedule, and time zone before confirming a scheduled message.

Yearning Map is not responsible for consequences arising from a user’s incorrect recipient selection, incorrect scheduling choices, or failure to cancel a message in time, except where liability cannot lawfully be excluded.

6. No Guarantee of Recipient Conduct or Outcomes

Yearning Map cannot control how recipients interpret, respond to, preserve, share, or act upon messages.

We are not responsible for a recipient’s failure to respond, disagreement with a message, disclosure of its contents, or conduct following receipt.

The platform does not guarantee reconciliation, closure, forgiveness, emotional relief, relationship improvement, confidentiality between users, or any other personal or interpersonal result.

Any decision to send, receive, act upon, or rely on a message is made by the relevant user or recipient at their own discretion.

7. Blocking, Moderation, and Account Restrictions

Recipients may have the ability to block senders or otherwise restrict communications.

Where blocking prevents delivery under the platform’s functionality, pending messages may not be delivered.

We may investigate suspected misuse, restrict access, remove content where appropriate, suspend accounts, or terminate access where reasonably necessary to enforce these Terms, protect users, maintain platform security, or comply with legal obligations.

We do not promise to review every message before delivery or to detect every instance of unlawful or harmful conduct.

Nothing in this section prevents us from complying with valid legal requests or exercising rights and obligations imposed by applicable law.

8. Message Privacy and Data Handling

We respect user privacy and process personal information in accordance with our applicable Privacy Policy and relevant data protection laws.

However, you acknowledge that digital services involve technical processing, storage, transmission, and security risks. We cannot guarantee absolute confidentiality or that information will never be affected by unauthorized access, system vulnerabilities, service-provider incidents, or other security events.

You should not submit passwords, financial account credentials, highly sensitive personal information, or information you are not legally entitled to disclose.

Messages may be processed or accessed to the extent reasonably necessary for service operation, troubleshooting, security, abuse prevention, legal compliance, or other purposes disclosed in our Privacy Policy and permitted by law.

We do not promise that messages are end-to-end encrypted unless the platform expressly states and implements that protection.

Nothing in these Terms authorizes us to disregard applicable privacy obligations, lawful data-subject rights, or legally required security measures.

9. Account Deletion and Message Removal

You may request account deletion through the available account controls, subject to applicable technical and legal requirements.

Where supported by the platform, deleting your account may also remove messages associated with that account, including pending messages that have not yet been delivered.

You acknowledge that deletion may be permanent and that we may be unable to restore deleted content or recover your account.

Deletion may not immediately remove information from backups, security logs, records retained for legal compliance, or copies already received or independently stored by another user. Such information will be handled in accordance with applicable law and our Privacy Policy.

We do not guarantee the recovery of deleted accounts, messages, or other content.

10. Third-Party Services and Technical Dependencies

For operational purposes, Yearning Map relies on third-party providers for functions such as hosting, databases, authentication, file storage, email delivery, and location lookup.

We do not control the independent operations, availability, policies, or security practices of third-party services.

To the extent permitted by applicable law, we are not responsible for disruptions or losses caused by third-party services beyond our reasonable control. This does not exclude liability for our own acts or omissions where such exclusion is prohibited by law.

Your use of third-party services may also be subject to their respective terms and privacy policies.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Yearning Map is provided on an “AS IS” and “AS AVAILABLE” basis.

We make no express or implied warranties except those that cannot lawfully be excluded, including any applicable statutory warranties or consumer rights.

To the extent legally permissible, we do not warrant that:

  • The service will operate continuously or without errors.
  • Scheduled messages will be delivered successfully or at an exact time.
  • Messages or account data will never be lost, corrupted, delayed, duplicated, or inaccessible.
  • The platform will meet every user’s expectations or particular requirements.
  • Every technical vulnerability, security incident, or unauthorized activity will be prevented.

No description of the platform, feature, delivery estimate, or promotional statement constitutes a guarantee unless expressly stated as such and legally binding.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Yearning Map and its owners, operators, affiliates, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of, inability to use, or failure of the platform.

This limitation includes, where legally permissible, losses relating to:

  • Delayed, failed, missed, duplicated, or incorrectly timed message delivery.
  • Lost, inaccessible, corrupted, or deleted messages or account data.
  • A recipient’s failure to read, acknowledge, or respond to a message.
  • Disputes, misunderstandings, emotional distress, reputational harm, or relationship consequences arising from user communications.
  • Unauthorized disclosure or access, subject to applicable legal duties and liability for matters that cannot lawfully be excluded.
  • Service interruptions, third-party failures, or events beyond our reasonable control.
  • Decisions made by users or recipients based on messages transmitted through the platform.

To the maximum extent permitted by law, our aggregate liability for claims arising from the service will be limited to the amount, if any, you paid directly to Yearning Map for the service during the twelve (12) months preceding the event giving rise to the claim.

If you used the service free of charge and applicable law permits this limitation, our aggregate liability will be limited to the minimum amount required by applicable law.

These limitations apply only to the extent permitted by law. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence where exclusion is prohibited, death or personal injury where exclusion is prohibited, breaches of mandatory data protection obligations, non-waivable consumer rights, or any other liability that cannot lawfully be excluded or restricted.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Yearning Map and its owners and operators against third-party claims, losses, liabilities, and reasonable legal expenses arising directly from your unlawful use of the platform, your violation of these Terms, or your infringement of another person’s rights.

This obligation does not apply to the extent a claim results from our own unlawful conduct, negligence where legally relevant, breach of statutory obligations, or other conduct for which you cannot legally be required to indemnify us.

We will not impose an indemnification obligation that overrides mandatory consumer protections.

14. Force Majeure and Events Beyond Our Control

We will not be responsible for delay or failure to perform to the extent caused by events beyond our reasonable control, including natural disasters, internet or telecommunications failures, power outages, cyberattacks, widespread infrastructure disruptions, government actions, legal restrictions, and failures of essential third-party services.

This provision does not remove obligations that applicable law requires us to fulfill despite such events.

15. Suspension, Termination, Discontinuation, and Changes to the Service

We may suspend, restrict, modify, or discontinue all or part of Yearning Map where reasonably necessary for maintenance, security, legal compliance, prevention of misuse, or business reasons.

Yearning Map is an independently operated platform, and we reserve the right to permanently shut down the service. If we do, we will take reasonable steps to notify users in advance where practicable and legally required, and to permanently delete personal data and user-generated content from our active systems, including account information, profiles, messages, scheduled messages, and associated records, as described in our Privacy Policy.

Once the service has closed and deletion is complete, we may be unable to recover accounts, messages, or other user content. You are responsible for saving any information you wish to preserve before the service closes.

Where reasonably practicable and legally required, we will provide notice of material changes or discontinuation.

We may revise these Terms from time to time. The latest version will be published on the platform with its effective date.

Material changes will take effect in accordance with applicable notice and consent requirements. Continued use after the effective date may constitute acceptance only where legally permitted. If you do not agree to revised Terms, you should stop using the service.

16. Governing Law and Disputes

These Terms are governed by the laws that apply to the operation of Yearning Map, excluding conflict-of-law rules to the extent permitted by law.

Any dispute arising from the service will be handled by the courts or other dispute-resolution bodies with appropriate jurisdiction, subject to mandatory consumer rights, applicable privacy laws, and any legally required dispute-resolution procedures.

Nothing in this section prevents a consumer from exercising a right to bring a claim before a court or authority where applicable law permits or requires it.

17. Severability and No Waiver

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be limited or severed only to the extent necessary. The remaining provisions will continue to apply.

A failure to enforce any provision does not constitute a waiver of the right to enforce it later.

18. Entire Agreement

These Terms, together with the applicable Privacy Policy and any additional terms expressly incorporated into them, govern your use of Yearning Map.

They do not override any separate agreement or mandatory legal right that cannot lawfully be excluded.
